Terms of Sale

These terms apply to every kitchen and product purchased from The Outdoor Kitchen Kit, LLC (“TOKK,” “we” or “us”), whether you buy from us directly or through an authorized TOKK dealer.

1. The agreement

By placing an order, you accept these Terms of Sale and our Warranty & Care terms. Together with your signed design and quote, they are the full agreement between you and TOKK. They replace anything said or written before your order. Any change to these terms must be in writing and signed by you and an authorized TOKK representative.

We may update these terms from time to time. The version posted on the date you place your order is the one that applies.

2. Orders and payment

Your kitchen is built to your signed design. Orders placed directly with TOKK require a 50% deposit to start production. The remaining 50% is due before delivery.

If you buy through a dealer, your dealer sets your payment schedule. Countertops are paid to the countertop fabricator on their own terms.

3. Changes and cancellations

Production starts soon after the deposit is paid, so most changes can’t be made once your order is placed. If materials, cabinetry or appliances have already been ordered, a change requires a written change order and a fee that depends on the change.

Because every kitchen is built to a custom design, orders can’t be canceled once the deposit is paid, and deposits are non-refundable.

4. Pricing and product information

Prices can change at any time before you order. If a price drops after you order, we don’t refund the difference. Photos and renderings on our website and in the 3D designer show the general look of a product. Your kitchen will be built to your signed design and the specifications in your quote.

5. Delivery and receiving

Kitchens ship by freight on a pallet, with lift gate service, to the curb at your home, to your dealer’s shop, or for pickup at our shop in Hurricane, Utah. Delivery is quoted separately from the kitchen. The carrier will call to schedule a delivery time. Someone must be there to receive and sign for the shipment.

When your kitchen arrives:

  1. Count the pieces and check everything for damage before you sign.
  2. Write “damaged” on the delivery receipt if anything is wrong.
  3. Refuse the shipment if the damage is severe.
  4. Call us at 702-900-5620 within 2 business days to report any damage. Keep all packaging and send photos.

Don’t install or use a damaged item until we agree on a fix. Depending on the damage, we may repair it, send a replacement part or piece, or offer a discount to keep it as is. Damage not reported within 2 business days isn’t covered.

6. Site, measurements and access

You or your dealer are responsible for accurate measurements, a solid and level surface for the kitchen, and a clear path from the delivery point to the kitchen location. If a piece doesn’t fit because of a measurement error, we can usually build a replacement quickly, with a replacement fee that depends on the piece.

Plan your utilities before you order. Gas, power and water should be stubbed at the kitchen location before the base is set.

7. Gas, electrical and plumbing

All gas, electrical and plumbing connections must be made by licensed professionals. Never connect a gas supply line to an outdoor cooking appliance without the correct pressure regulator for your gas type (natural gas or propane). Doing so can cause fire, explosion, serious injury or property damage, and voids all warranties.

8. Permits and HOA rules

TOKK makes no promise about permits or approvals. You are responsible for finding out and following any state or local laws, building codes, setbacks, and HOA or condo association rules, including permits for gas, electrical, water or sewer connections.

9. Warranty

TOKK’s warranty is described on our Warranty & Care page. Cabinetry, grills and appliances are covered by their manufacturers, and countertops by the fabricator who made them. Except as stated on that page, we make no other warranties, express or implied.

10. Limits on our responsibility

We aren’t responsible for labor costs, project delays or other costs caused by a delayed, damaged or defective item. We recommend scheduling other trades only after your kitchen has arrived and been inspected. If an appliance or cabinet is backordered, we usually hold the full order so everything ships together.

11. Waiver of jury trial

You and TOKK knowingly, voluntarily and intentionally waive any right to a trial by jury in any lawsuit related to the products purchased from TOKK.
